Consumer Law & Dispute Resolution

Overview

The Chambers has an active consumer law practice before the National Consumer Disputes Redressal Commission (NCDRC), representing aggrieved buyers, flat owners, and consumers in matters relating to housing, insurance, and medical negligence. Our lawyers have pursued and successfully concluded several matters before the NCDRC against some of India’s largest real estate developers — including Omaxe, Unitech, Emaar, BPTP, and Parasvnath — obtaining relief ranging from full refunds with interest to immediate possession orders.

Consumer disputes, particularly in the housing sector, involve a combination of contract law, consumer protection legislation, and an understanding of how builders structure their agreements and delay their obligations. We approach these matters with the same rigour we bring to commercial arbitration — preparing the case thoroughly and pursuing the maximum relief available under law.

What We Do

  • Consumer complaints before the NCDRC and State Consumer Commissions
  • Delay of possession claims — praying for possession with interest at 18% for the delayed period, or complete refund with 18% interest on amounts paid
  • Deficiency of service claims in housing and real estate projects
  • Claims against builders for delayed possession, incomplete construction, and failure to deliver as per agreed specifications
  • Insurance disputes — wrongful repudiation of insurance contracts, incorrect invocation of contract conditions, and delayed claim processing
  • Medical negligence claims — deficiency of service against hospitals, clinics, and medical practitioners
  • Pre-litigation advisory on consumer remedies and forum selection
